About these terms
These Terms of Service (“Terms”) govern your access to and use of the Recognition of Prior Learning (RPL) assessment platform and related services (the “Service”) provided by Techskill Academy ([Legal entity name], ABN [ABN], RTO [RTO code]) (“we”, “us”, “our”).
By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old and able to enter into a legally binding agreement to use the Service. You agree to provide accurate, current, and complete information about yourself and your experience.
The Service
The Service lets you provide information and evidence about your skills and work experience so we can assess your eligibility for Recognition of Prior Learning towards a nationally recognised qualification, and book an appointment with an assessor.
The Service helps you understand your potential RPL outcome. It does not by itself grant, guarantee, or confirm any qualification or unit of competency. Any qualification outcome is subject to our formal assessment processes and our obligations as a registered training organisation.
Your account and security
Access to your account uses verification by a code sent to your mobile number by SMS. You are responsible for keeping access to your mobile number secure and for activity that occurs under your account. Please notify us promptly if you believe your account has been accessed without authorisation.
Acceptable use
You agree to use the Service lawfully and honestly, to provide truthful information and genuine evidence, and not to: submit false, misleading, or fraudulent information; impersonate another person; upload malicious code or attempt to interfere with or gain unauthorised access to the Service; or use the Service in a way that infringes the rights of others or breaches any law.
Assessment, outcomes, and fees
Assessment results provided through the Service are indicative and form part of a broader assessment process. Final decisions about qualifications, units of competency, study requirements, credit, and any licensing matters are made by us through our formal RTO processes and confirmed with you directly.
Any fees for qualifications or related services are quoted to you separately and are not payable through the assessment questionnaire itself.
Bookings
Appointments may be scheduled through a third-party booking provider, and your use of that provider may be subject to its own terms. We are not responsible for the availability of third-party scheduling services.
Intellectual property
The Service, including its content, software, design, and trade marks, is owned by us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.
You retain ownership of the information and evidence you submit, and you grant us a licence to use it for the purpose of providing the Service and assessing your Recognition of Prior Learning.
Privacy
Our collection and handling of your personal information is described in our Privacy Policy, which forms part of these Terms.
Third-party services
The Service relies on third-party providers (for example, messaging, scheduling, hosting, and AI-assisted processing). We are not responsible for the acts or omissions of third parties, or for third-party websites or services linked from the Service.
Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Subject to those rights, the Service is provided on an “as is” and “as available” basis, and to the extent permitted by law we do not warrant that it will be uninterrupted, error-free, or fit for any particular purpose beyond what is described.
Limitation of liability
To the maximum extent permitted by law, and subject to the Australian Consumer Law, we are not liable for any indirect, incidental, special, or consequential loss arising from your use of the Service. Where our liability for a failure to comply with a consumer guarantee cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.
Indemnity
You agree to indemnify us against any loss or claim arising from your breach of these Terms or your misuse of the Service, except to the extent the loss or claim was caused by us.
Suspension and termination
We may suspend or terminate your access to the Service if you breach these Terms, or where reasonably necessary to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination will continue to apply.
Changes
We may update the Service and these Terms from time to time. The current version will be available on our website with the date it was last updated. Continued use after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from them.
